Features

Public Liability – limits of indemnity from £2m to £25m

To protect the insured against damages being sought for death or injury or damage to property against tour operators or travel agents. We include liability that attaches to the operator for all component parts of a Package as defined under “Package Travel, Package Holidays and Package Tour Regulations 1992” and the “Package Travel and Linked Travel Arrangements Regulations 2018”. Cover includes:

  • Corporate Manslaughter and Corporate Homicide defence costs included
  • 24/7 Crisis costs and expenses included
  • Code Civile extension – to comply with French law
  • Liability arising out of the use of all vehicles, vessels or aircraft outside of the policyholders control.
  • Worldwide Jurisdiction (USA/Canada costs inclusive)
  • No injury excess
Professional Indemnity £1,000,000 Indemnity limit is any one loss

To provide protection to the insured for any claims for compensation by dissatisfied customers where injury or property damage is not involved and there are allegations of an error or omission on the part of the operator or their agents.

The Financial Conduct Authority have stated exact Professional Indemnity Insurance requirements in respect of the Sale of Insurance. As from October 2024 the FCA requirement is increasing to €2,315,610. We can endorse the Professional Indemnity section of our policy(s) up to £2,000,000 any one claim and provide one inclusive indemnity buy-back to ensure full cover at all times.

Employers’ Liability (optional)

To provide indemnity for any claims arising out of injury to employees in the course of their employment within the UK and also whilst working temporarily abroad. This insurance is compulsory for any UK Employer under the terms of the Employers’ Liability (Compulsory Insurance) Act 1969.

Emergency Assistance £5,000

The Package Travel Regulations and the ABTA Code of Conduct require tour operators to provide ‘general assistance’ including initial legal costs to any client who suffers a mishap arising from any activity outside of what was included within the packaged holiday.

Public Relations and Media expenses £25,000 (optional)

Fees and expenses to employ specialist PR / Media consultant to proactively manage any event involving death or emergency hospitalisation or kidnap or hijack under any section of the policy including PL, Pii and EL.

Legal Defence Costs £100,000

Legal costs incurred to defend the insured against criminal proceedings brought against the insured in respect of any actual or alleged breach of:

  • The Health and Safety At Work Act 1974
  • Part II of the Consumer Protection Act 1987
  • The Trade Descriptions Act 1968
  • The Package Travel Regulations 1992
  • Package Travel and Linked Travel Arrangements Regulations 2018
